1. Agreement to Terms

1.1 Acceptance of Terms

By downloading, installing, accessing, or using the Jeebu ABA Buddy mobile application ("Jeebu," "App," "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Jeebu AI ("Jeebu," "we," "our," or "us").

1.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through:

Your continued use of the App after changes constitute acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and uninstall it from your device.

2. Eligibility and Account Requirements

2.1 Age Requirements

You must be at least 18 years old to use Jeebu ABA Buddy. The App is designed for:

• Parents and legal guardians of children receiving therapy
• Licensed therapists and healthcare professionals
• Caregivers authorized by parents/guardians

2.2 Professional Use

If you are a licensed therapist or healthcare professional:

• You represent that you hold valid, current licensure in your jurisdiction
• You agree to comply with all applicable professional standards and regulations
• You accept responsibility for maintaining appropriate professional liability coverage
• You acknowledge that the App is a tool and does not replace professional judgment

2.3 Parental/Guardian Authority

By creating a child profile, you represent that you are:

• The parent or legal guardian of the child, OR
• A licensed professional with proper authorization from the parent/guardian, OR
• A caregiver with written permission from the parent/guardian

2.4 Accurate Information

You agree to provide accurate, current, and complete information when using the App and to update information as necessary.

3. License and Restrictions

3.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Download and install the App on a device you own or control
• Use the App solely for personal, non-commercial purposes related to therapy tracking and planning

3.2 Restrictions

You agree NOT to:

• ❌ Use the App to harm, abuse, or endanger any child
• ❌ Share or distribute child profiles or therapy data without proper authorization
• ❌ Violate any laws, regulations, or professional standards
• ❌ Use the App for research purposes without prior written consent
• ❌ Impersonate any person or entity
• ❌ Interfere with or disrupt the App's operation

Prohibited Technical Actions:

• ❌ Reverse engineer, decompile, or disassemble the App
• ❌ Modify, adapt, or create derivative works of the App
• ❌ Remove or alter any copyright, trademark, or proprietary notices
• ❌ Use any automated systems (bots, scrapers) to access the App
• ❌ Attempt to gain unauthorized access to our systems or networks
• ❌ Transmit viruses, malware, or harmful code
• ❌ Bypass any security features or access controls

Prohibited Commercial Uses:

• ❌ Sell, rent, lease, or sublicense the App
• ❌ Use the App to provide commercial services to third parties
• ❌ Extract data for commercial databases or products
• ❌ Frame or mirror any part of the App without permission

3.3 Intellectual Property

All rights, title, and interest in the App, including all intellectual property rights, remain with Jeebu AI. This includes:

• Software code and architecture
• AI algorithms and models
• User interface designs
• Graphics, logos, and trademarks
• Content and materials provided by us

The "Jeebu" name and logo are trademarks of Jeebu AI and may not be used without permission.

3.4 Your Content

You retain ownership of all data you input into the App ("User Content"), including:

• Child profile information
• Trial logs and session notes
• Custom goals and observations

By using the App, you grant us a limited license to process User Content solely to:

• Provide App functionality (generate lesson plans, display statistics)
• Improve AI algorithms (using anonymized data only)
• Comply with legal obligations

We will never sell or share your User Content except as described in our Privacy Policy.

4. Subscription Terms

4.1 Free Features

The App offers basic features at no cost, including:

• Child profile creation and management
• Manual trial logging
• Basic progress tracking
• Limited lesson plan generation

4.2 Pro Subscription

Premium features require a paid subscription ("Pro"), including:

• Up to 30 monthly AI-powered lesson plans
• Advanced task breakdowns
• Detailed progress analytics
• Priority support
• Future premium features

4.3 Pricing and Payment

Subscription Plans:

• Monthly: $9.99/month (USD)
• Pricing may vary by region and currency

Payment Processing:

• All payments are processed through Apple App Store
• Prices are shown before purchase confirmation
• Payment is charged to your Apple ID account at purchase confirmation
• We do not directly process or store payment information

4.4 Auto-Renewal

Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.5 Managing Subscriptions

To manage or cancel your subscription:

1. Go to iPhone Settings → Your Name → Subscriptions
2. Select Jeebu ABA Buddy
3. Choose "Cancel Subscription"

Cancellation takes effect at the end of the current billing period. You will retain Pro access until then.

4.6 Refunds

All sales are final. Refunds are handled by Apple according to their policies. We do not control Apple's refund decisions. To request a refund:

1. Go to reportaproblem.apple.com
2. Sign in with your Apple ID
3. Find Jeebu ABA Buddy purchase
4. Select "Request a Refund"

4.7 Free Trials

We may offer free trial periods for Pro subscriptions. Terms:

• Free trial length will be displayed before signup
• You will not be charged during the trial period
• You can cancel anytime during the trial without charge
• If you don't cancel, you'll be charged when the trial ends
• Previous trial users may not be eligible for additional trials

4.8 Price Changes

We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current subscription period. You may cancel before the new price takes effect.

5. Medical Disclaimer

The App is a therapy tracking and planning tool only. It is NOT:

• ❌ A substitute for professional medical or therapeutic advice
• ❌ A diagnostic tool
• ❌ A treatment or intervention device
• ❌ A replacement for licensed therapy services
• ❌ FDA-approved or cleared medical software

5.2 No Doctor-Patient Relationship

Use of the App does not create a doctor-patient, therapist-client, or healthcare provider-patient relationship between you and Jeebu AI.

5.3 Professional Consultation Required

You should always:

• ✅ Consult with qualified healthcare professionals before making therapy decisions
• ✅ Follow your licensed therapist's or doctor's treatment plans
• ✅ Seek professional help for medical emergencies
• ✅ Verify AI-generated content with qualified professionals before implementation

5.4 AI-Generated Content

AI-generated lesson plans and task breakdowns are suggestions only and may contain errors. You must:

• Review all AI-generated content carefully
• Verify appropriateness with qualified professionals
• Adapt content to your child's specific needs
• Use professional judgment

5.6 No Guaranteed Results

We make no guarantees or warranties regarding:

• Therapy outcomes or progress
• Accuracy of AI-generated content
• Suitability of suggested interventions
• Behavioral improvements

Individual results may vary. Therapy effectiveness depends on many factors beyond the App's control.

6. Privacy and Data Security

6.1 Privacy Policy

Our collection, use, and protection of your information is governed by our Privacy Policy, which is incorporated into these Terms. Key points:

Data We Don't Collect:

• ❌ Date of birth or precise age
• ❌ Home address or location
• ❌ Medical diagnoses or detailed health information
• ❌ Photos or videos

Data Security:

• iOS file system encryption
• HTTPS/TLS for data transmission
• No cloud backups without your explicit consent
• PII sanitization in error reports

6.2 Your Responsibilities

You are responsible for:

• Maintaining the security of your device
• Using device passcodes and biometric locks
• Not sharing your device with unauthorized individuals
• Backing up your data (if desired)
• Securing your Apple ID account

6.3 Data Loss

We are not responsible for data loss resulting from:

• Device loss, theft, or damage
• Device resets or OS updates
• App deletion or uninstallation
• Hardware or software failures
• User error

Always maintain separate backups of critical therapy data.

7. User Conduct and Responsibilities

7.1 Professional Standards

If you are a licensed professional, you must:

• Comply with all applicable professional codes of ethics
• Maintain appropriate documentation outside the App as required by law
• Obtain necessary informed consent from clients/families
• Maintain professional liability insurance
• Report any suspected child abuse or neglect as legally required

7.2 Appropriate Use

You agree to use the App:

• ✅ In the best interest of the child
• ✅ In compliance with all applicable laws and regulations
• ✅ Ethically and responsibly
• ✅ With respect for privacy and confidentiality

7.3 Data Accuracy

You are responsible for:

• Entering accurate trial and session data
• Reviewing and correcting errors promptly
• Maintaining organized and complete records
• Properly attributing data entry (who logged what)

7.4 Prohibited Content

You may not input or store content that is:

• ❌ Illegal or promotes illegal activity
• ❌ Defamatory, libelous, or fraudulent
• ❌ Harmful to minors
• ❌ Violates third-party rights
• ❌ Contains viruses or malicious code

7.5 Child Safety

You must:

• ✅ Ensure all interventions are safe and appropriate
• ✅ Never implement strategies that could harm a child
• ✅ Adapt AI suggestions to individual needs and safety considerations
• ✅ Consult professionals before trying new interventions
• ✅ Stop any intervention that causes distress or harm

8. Disclaimers and Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• ❌ Fitness for a particular purpose
• ❌ Non-infringement
• ❌ Accuracy or reliability
• ❌ Uninterrupted or error-free operation
• ❌ Security or freedom from viruses

8.2 No Warranty for AI Content

We make no warranties regarding:

• Accuracy of AI-generated lesson plans or task breakdowns
• Suitability of suggested interventions
• Completeness or appropriateness of AI content
• Absence of errors or omissions in AI outputs

8.3 Third-Party Services

We are not responsible for:

• Apple App Store availability or policies
• iOS updates or compatibility issues
• Third-party service outages (AI providers, payment processors)
• Internet connectivity or network issues

Excluded Damages:

• ❌ Indirect, incidental, special, consequential, or punitive damages
• ❌ Loss of profits, revenue, data, or goodwill
• ❌ Service interruptions or delays
• ❌ Therapy outcomes or lack of progress
• ❌ Reliance on AI-generated content
• ❌ Data loss or corruption
• ❌ Unauthorized access to your device
• ❌ Injury or harm resulting from App use

8.5 Basis of the Bargain

You acknowledge that the disclaimer and limitation of liability reflect a reasonable allocation of risk and are fundamental elements of the agreement between you and Jeebu AI. The App would not be provided without these limitations.

8.6 Jurisdictional Variations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

9. Indemnification

9.1 Your Indemnification Obligation

You agree to indemnify, defend, and hold harmless Jeebu AI, its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

Indemnified Claims:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any laws or regulations
• Your violation of any third-party rights (including privacy rights)
• Any therapy decisions or interventions you implement
• Professional malpractice or negligence
• Harm or injury to any child
• Unauthorized disclosure of data
• Your User Content

9.2 Defense and Settlement

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims. You may not settle any claim without our prior written consent.

10. Termination

10.1 Termination by You

You may stop using the App at any time by:

• Uninstalling the App from your device
• Canceling your Pro subscription (if applicable)
• Deleting all child profiles and data

10.2 Termination by Us

We reserve the right to suspend or terminate your access to the App immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You abuse or misuse the App
• We suspect harm to a child
• Required by law or government authority
• We cease offering the App

10.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ends
• You must uninstall the App and cease all use
• Pro subscription benefits will end (no refund for partial periods)
• Data stored locally on your device will remain until you delete it
• Provisions that should survive termination will remain in effect

10.4 Survival

11. Dispute Resolution

11.1 Informal Resolution

Before filing a claim, you agree to first contact us at aijeebu@gmail.com and attempt to resolve the dispute informally. Provide:

• Your name and contact information
• Description of the dispute
• Relief requested

We will attempt to resolve the dispute within 30 days.

11.2 Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration rather than in court, except:

• Small claims court actions (if eligible)
• Intellectual property disputes
• Emergency injunctive relief

Arbitration Rules:

• Administered by the American Arbitration Association (AAA)
• Conducted under AAA's Consumer Arbitration Rules
• Single arbitrator selected per AAA rules
• Location: Your county of residence or by video/phone conference
• Language: English
• Costs: We will pay AAA filing, administration, and arbitrator fees for claims under $10,000

11.4 Jury Trial Waiver

YOU AND JEEBU AI WAIVE THE RIGHT TO A JURY TRIAL.

If arbitration does not apply, any judicial proceeding shall be decided by a judge without a jury.

11.5 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.

If arbitration does not apply, you agree to submit to the exclusive jurisdiction of state and federal courts located in Delaware.

11.6 Statute of Limitations

Any claim or cause of action arising out of your use of the App must be filed within one (1) year after the claim arose, or it will be permanently barred.

12. HIPAA and Healthcare Compliance

12.1 Not a HIPAA Covered Entity

Jeebu AI is not a HIPAA covered entity or business associate. We do not provide healthcare services, and we are not subject to HIPAA obligations.

12.2 User Responsibilities

If you are a HIPAA-covered healthcare provider:

• You are responsible for complying with HIPAA and other healthcare regulations
• The App is a tool that stores data locally on your device
• You must maintain your own HIPAA-compliant systems and procedures
• You must obtain necessary authorizations and consents
• You should not store Protected Health Information (PHI) beyond what is necessary
• You should maintain separate, compliant medical records systems

12.3 Local Storage Model

Because the App stores data locally on your device:

• We do not access or control your therapy data
• You are the data controller
• You are responsible for securing your device
• Standard HIPAA transmission rules do not apply to local storage
• You control whether to enable iCloud backups (which may have HIPAA implications)

12.4 AI Processing

When using AI features, minimal anonymized information is transmitted. You are responsible for:

• Reviewing what data is sent (see Privacy Policy)
• Ensuring transmitted data does not constitute identifiable PHI
• Obtaining necessary patient authorizations if applicable

13. General Provisions

13.1 Entire Agreement

These Terms, together with the Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and Jeebu AI regarding the App and supersede all prior agreements and understandings.

13.2 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.

13.3 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.

13.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

13.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated.

13.6 Force Majeure

We shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including:

• Acts of God
• Natural disasters
• War or terrorism
• Government actions
• Internet or telecommunications failures
• Third-party service outages

13.7 Export Compliance

You agree to comply with all applicable export and import laws and regulations. You represent that you are not:

• Located in a country subject to U.S. government embargo
• Listed on any U.S. government list of prohibited or restricted parties

13.8 Apple-Specific Terms

Acknowledgment:

• You acknowledge that these Terms are between you and Jeebu AI, not Apple
• Jeebu AI, not Apple, is responsible for the App and its content
• Apple has no obligation to provide support or maintenance for the App

Scope of License:

• The license granted is limited to a non-transferable license to use the App on Apple-branded products you own or control
• The App is licensed, not sold

Maintenance and Support:

• Jeebu AI is solely responsible for providing maintenance and support
• Apple has no support obligations

Warranty:

• To the extent the App fails to conform to any applicable warranty, you may notify Apple for a refund
• Apple has no other warranty obligations regarding the App

Product Claims:

Jeebu AI, not Apple, is responsible for addressing claims relating to the App, including:

• Product liability claims
• Claims that the App fails to conform to legal requirements
• Claims arising under consumer protection or similar legislation

Intellectual Property:

In the event of any third-party claim that the App infringes intellectual property rights, Jeebu AI (not Apple) is responsible for investigation, defense, settlement, and discharge of such claims.

Legal Compliance:

You represent that you are not located in a country subject to U.S. embargo or on a U.S. government prohibited party list.

Third-Party Terms:

You agree to comply with applicable third-party terms when using the App.

Third-Party Beneficiary:

• Apple and its subsidiaries are third-party beneficiaries of these Terms
• Upon your acceptance, Apple has the right to enforce these Terms against you

13.9 U.S. Government Rights

If you are a U.S. government entity, the App is "commercial computer software" and "commercial computer software documentation" as those terms are used in 48 C.F.R. §12.212. Use, duplication, or disclosure is subject to the restrictions set forth in these Terms.

13.10 Language

These Terms are written in English. Any translations are provided for convenience only. In the event of conflicts, the English version controls.

13.11 Notices

14. Acknowledgment and Consent

14.1 You Acknowledge That:

• ✅ You are at least 18 years old
• ✅ You have authority to use the App for the children in your care
• ✅ The App is a tool, not a replacement for professional services
• ✅ AI-generated content requires professional review
• ✅ You are responsible for therapy decisions and outcomes
• ✅ Data stored locally is your responsibility to secure and backup

14.2 You Agree To:

• ✅ Use the App in compliance with all applicable laws
• ✅ Act in the best interest of children in your care
• ✅ Seek professional guidance for therapy decisions
• ✅ Maintain appropriate safeguards for sensitive data
• ✅ Arbitrate disputes rather than pursue litigation
• ✅ Accept the limitations of liability described herein
